General Terms and Conditions of Use of the game Airlines-Manager.com

Introduction

The General Terms and Conditions presented below govern the contractual relations between all users of the site Airlines-Manager.com or the app Airlines Manager Tycoon (hereinafter referred to as "User” or “Player”) and PLAYRION SARL with a capital of €35,440, with its headquarters at 40/42 rue Barbès, Montrouge France and registered on the Trade and Companies register of Nanterre (France) under the number 524 958 188 (hereinafter referred to as “Us").

The game Airlines-Manager.com, the app Airlines Manager Tycoon and its services, including the app Airlines Painter, are the property of PLAYRION.

Users must start by registering in order to play the game or be able to use our services. For this, Users must create an account. After successfully registering their account, Users will receive access to the free standard version. Playing time for this standard version is unlimited. The Users game experience may be enhanced by acquiring AM Coins (or TravelCards) and by the subscription to additional modules. For further information, please refer to the General Terms and Conditions of Sale - AM Coins & TravelCards.

The sole purpose of participating in the game Airlines Manager is to provide entertainment for Users. Thus, we hope that our game offers you pleasure and satisfaction.

§ 1 - Scope of these General Terms and Conditions of Use

These General Terms and Conditions of Use govern the use made of the game owned by PLAYRION, as well as the services provided in the frame of the game Airlines Manager. These General Terms and Conditions of Use do not in any way concern matters relating to third-party services - including, for example, access to the Internet.

PLAYRION provides Users with management games via browsers or mobile apps. Therefore, PLAYRION’s games and services require the use of a computer, a telephone, or a tablet connected to the Internet. If used via other terminals adapted to Internet use, the functions and/or their display may be reduced. PLAYRION may not be held responsible in the event of a failure of these terminals with access to the Internet (other than a computer).

The validity of any Terms and Conditions of Use issued by you or by other Users is expressly rejected. These eventual Terms and Conditions of Use may be integrated into the contract if, and only if, we have expressly approved them. You have the right to save and print these General Terms and Conditions of Use.

§ 2 - Authorization of use

Participation in the games and services provided by PLAYRION is solely for entertainment purposes. Thus, we only offer our services to end consumers. It is forbidden to use the game or its services for commercial or illegal purposes without a contractual agreement with PLAYRION.

The use of the games and services is authorized only if you are 18 years and over, or if your legal guardian has approved this use. In the frame of their registration, in order to use the game Airlines Manager, Users must expressly confirm that they are majors (a) and that they have the legal capacity (b); if Users are still minors, they must ensure that they have obtained the agreement of their legal representative. PLAYRION reserves the right to request written proof of this at any time and to carry out the necessary checks. Any participating minor who is unable to provide this proof within a period of 15 days will lose the benefit of their AM Coins and TravelCards and will be excluded from the game Airlines Manager

In the frame of a registration, Users acknowledge having read and accepted these General Terms and Conditions of Use and General Terms and Conditions of Sale.

§ 3 - Purpose of the contract and scope of the services

Participation in the game Airlines Manager is solely for the purpose of entertainment. It is forbidden to use the game Airlines Manager and its services for commercial purposes unless a commercial agreement has been established with Playrion.

Airlines Manager provides Users with a service that allows them to simulate the payment methods in the game (symbolized by $). This virtual money does not constitute real money but a fully-fledged element of the game. It is expressly forbidden to proceed with the trade or exchange of virtual money for real money. PLAYRION expressly declares never having exchanged or never exchanging in the future any virtual money for real money.

Users declare that they are aware that the virtual goods - with which they can trade in the game - do not, in law, constitute actual “objects” or anyone’s property. They are just elements of the game associated to their account. When Users buy virtual goods, they do not become their “owners”.

Above all, PLAYRION wants to offer Users the chance to use the different elements of the game as well as possible, even if the terms used may sometimes suggest other interpretations. Without prejudice to other agreements or other rights, this user license ceases when the contract between the two parties comes to an end, in particular when it is terminated. Provided that the regulations in force have not been modified, the objects exchanged and any virtual money that still exists will expire when the contract is terminated.

The names of the aircraft manufacturers that appear in the game Airlines Manager are not used for commercial purposes but in order to create an additional immersive effect. The characteristics of the models present in the game Airlines Manager are provided only as an example and do not in any way constitute a contractual fact. PLAYRION undertakes to change names or characteristics in the event of a dispute with the brands’ owners in the absence of reaching a compromise.

If the terms used do not imply other interpretations, it means, in the frame of the transfer of virtual goods and virtual money, that the term “sell” refers to the “transfer of the rights to a license to use virtual money, virtual goods, objects, or any other content on your part for which compensation should be provided and which is in agreement with these General Terms and Conditions of Use”. Consequently, “buy” refers to “the intimation of a license to use virtual money or goods, objects or any other content in exchange for the payment of compensation by Users, for which the user license is in agreement with these General Terms and Conditions of Use”. The terms “buyer”, “vendor” and “acquisition”, as well as any other similar terms have the corresponding meanings.

As soon as a customer account (“airline”) is created, the game Airlines Manager becomes accessible. Users then receive access to a free standard version of the game Airlines-Manager.com. Users are then free to subscribe or not to the additional modules via the acquisition and use of “AM Coins” and “TravelCards”. For further information, please refer to the General Terms and Conditions of Sale.

PLAYRION declares that it ensures 90% availability for the game Airlines Manager and its services per year. This calculation excludes interruptions resulting from technical or other problems which may arise beyond our sphere of influence (such as, for example, a case of force majeure or if a third-party were held liable), as well as interruptions resulting from routine maintenance operations. The responsibility of PLAYRION for the non-availability of the game and services, with premeditation and as a result of their negligence, remains intact. We are authorized to block Players’ access to our games and services in order to protect our electrical circuits, protect the integrity of our network, and, in particular, prevent serious disruptions for the network, software, or saved data.

PLAYRION reserves the right to refuse the creation of an account. Users do not have any right authorizing them to publish any content whatsoever belonging to PLAYRION.

§ 4 - Registration and accounts (“airlines”)

The Players’ participation and use of the game Airlines Manager requires prior registration. It is necessary to create an account in order to access the game Airlines Manager.

To register, Users must submit a request to open an account by completing the registration form that requires various items of information to be entered. To register correctly, Users must complete the form’s “mandatory” fields in full. All this data, regardless of whether it is in the “mandatory” fields or it has been entered optionally, must be accurate.

The request to open an account in the game Airlines Manager implies the acceptance of the General Terms and Conditions of Use for the game Airlines Manager. The acceptance of the request to open an account in the game Airlines Manager gives rise to the constitution of a synallagmatic contract between the User and PLAYRION, the editor of the game Airlines Manager.

The constitution of the synallagmatic contract implies the acceptance of the General Terms and Conditions of Use and the General Terms and Conditions of Sale of the game Airlines Manager.

The receipt of the request to open an account in the game Airlines Manager is confirmed automatically by email sent to the address provided. Only one sole account is authorized per person and per server/game mode (Multiple accounts are forbidden on the same server/game mode). It is also forbidden (still for the same person) to communicate using different accounts or interact with them in any other way (“pushing prohibited”) In particular, game accounts are not allowed to be used to grant advantages to other accounts. We expressly specify that any failure to prohibit multiple accounts will result in the account being closed immediately.

It is forbidden to transfer or sell any game account to a third-party. Any attempt to transfer, whether in exchange for payment or not, will result in the immediate closure of the account.

§ 5 - Right of cancellation

Users can cancel their declaration of acceptance of the contract of use in writing (e.g.: letter, or email) within a period of two weeks without having to justify their reasons.

Consequences of cancellation:

In the case of an actual cancellation, the services and any uses requested on both sides by both parties will be refunded. If Users are unable to return the services received to PLAYRION in part or in full or only in an altered state, Users must, if applicable, compensate PLAYRION accordingly. The duty to refund payments must be fulfilled within a period of 30 days. This period starts from PLAYRION’s receipt of your declaration of cancellation.

Are excluded from the right of cancellation:

The right of cancellation expires prematurely if the contract between the two parties is accepted in full as being satisfactory as it is expressly in the frame of their common agreement before the use of the right of cancellation has been exercised. This is based, in particular, on Users who have paid the full amount for the right to use AM COINS (or TravelCards).

 

§ 6 - Usage and modifications made to the game Airlines Manager and the services; prohibition to use unauthorized scripts

After creating their account in the game Airlines Manager and/or respective service, Users are free to access the game either via the PLAYRION website, or via a directory or partner that references the game Airlines manager, or by accessing it directly after entering the URL: http://www.airlines-Manager.com, or by using an official app published by PLAYRION on the official Android “Play Store” or iOS “AppStore”.

Users have the right to use the Airlines Manager game and services solely via a Web browser or the authorized software and apps which PLAYRION makes expressly available to Users (“Prohibition to use unauthorized scripts”). More specifically, it is forbidden to use programs which may generate an overload in Users’ traffic on the servers. This also applies for software which aims to systematically or automatically control all or part of the game and its functions (“bots, macros”), and also reproduce the game, elements of the game, or its content.

The game Airlines Manager and its services must provide its Users - and also many other potential Users - with lasting entertainment. As a result, the game and its services will be constantly updated, adapted, extended, and modified. Consequently, you have a right to use the game and the respective services in their current version. However, it should be noted that: Users cannot claim a version of the game or services in the state they were in when the contract was concluded; Users can also not demand or claim that Airlines Manager provides them with the game in a given state. Users must be aware of the fact that changes to the game and services may also lead, in particular, to changes in the use of the virtual money for the game Airlines Manager.

§ 7 - Obligations

The payment of the remunerations stipulated constitutes one of the most important obligations for Users with regard to PLAYRION in the case of Users not using the free standard version of the game. Another very important obligation is the validity and completeness of the data provided by Users in the frame of the creation or pursuit of the synallagmatic contractual relationship between PLAYRION and the Users.PLAYRION is authorized, immediately and without any delay being granted, to freeze or deactivate all or some of the contractual services as well as any further supplies, and also to terminate the contract.

On its game Airlines Manager, PLAYRION publishes the instructions and rules for the game. Users acknowledge being aware that by entering into the world of the game Airlines Manager, they play with many other Users and that they also communicate with various other Users via the services. To favor the success of the game in the community, it is necessary to comply with the rules.

When participating in the game, Users approve and confirm their acceptance of this obligations of the rules of this game. Furthermore, Users must abstain from anything that may hinder the activity of the game, its services or the game in the community.

Users must carefully select the information from the game Airlines Manager, the services, or information about PLAYRION that they wish to divulge. Thus, Users are also required, in the frame of the services, to not divulge advertising, political, religious, injurious, excessive, violent, sexist, pornographic content or any other content that is morally shocking or reprehensible, particularly racist (for example: images, videos, links, names or words) concerning people as well as any descriptions having the characteristics described above. Also, Users are obliged to not use terms, names, images, video, music extracts, games, or any other property which may be protected by law. If in doubt, Users must remove the content in question without delay. We also reserve the right to delete it ourselves. Users will pay constant attention to the corresponding regulations and laws, especially those concerning insults, the protection of young people, data, copyright, and brand rights.

Users are not allowed to use the game Airlines Manager and its services for illegal purposes and are required to comply with the regulations in force.
 
A violation of the afore-mentioned obligations authorizes PLAYRION - as a result of the violation of these obligations - to delete any information which is deemed unsuitable or which may prevent the corresponding transactions. In particular, PLAYRION is all the more entitled to do so if concrete proof of a violation of these General Terms and Conditions of Use or the rules of the game and services is brought to light.
 
In addition to this, we are entitled to exclude Users from future participation in the service concerned and after a repeat offense - despite a warning - to cancel their account immediately. We reserve the right to lodge future complaints, especially complaints in the form of damages.

Users are required to inform us if they become aware of the abusive use of the service by a third person and/or by another Player in relation to another User. In order to be able to ensure an effective intervention, we ask Users to send us this information in writing (for example by email).

§ 8 - Intellectual property and responsibility with regard to the content submitted to us

Users must be aware that third parties may consult information about PLAYRION that is sent to us and published around the world via the Internet. Users declare that they agree to provide this information.

Users are themselves responsible for any content published in the form of texts, data, images, photos, videos, sound, music extracts, works covered by copyright or any other elements, information, and more (hereinafter referred to as “Information that is submitted to us”) which they make available to PLAYRION via the game Airlines Manager or which they exchange with other Players.

We do not have complete control over the information submitted to us. We do not always systematically examine content prior to its publication. In this respect, it should be pointed out that if we are already aware of, or if we learn about the publication of illegal content, we will be obliged to delete it immediately. We are not in any way responsible for this content, especially with regard to its accuracy, completeness, and reliability.

§ 9 - Complaints in the case of malfunctions and reporting of malfunctions

We provide Users with the game Airlines Manager and its services in their respective existing version. Users may not in any way claim the maintenance or restoration of a defined state of the game and/or services, or request an extension of the functions of the game and/or services. They must be aware that the services and the game we are offering - in the same way as any software or program - cannot always achieve a level of total perfection. Therefore, a malfunction of the game and services is recognized only if the playability and use of the game is disrupted in a serious and lasting manner.

Users must always make a note of malfunctions that occur in the game and services, and other services of Airlines Manager and send them to us in writing specifying in as much detail as possible the error messages that appeared. Before communicating any errors to us, Users must always consult the instructions of the game or services, as well as all the analysis and problem-solving solutions that we provide (especially the frequently-asked questions and the discussion forums). Users must help us to resolve these malfunctions to the best of their ability.

Users are required to always inform us when they notice a malfunction. In the case of obvious malfunctions or errors - which also includes virtual goods - Users must report them to us within two weeks of the receipt of the goods concerned. In order to comply with this deadline, a simple notification sent within the given timescale is sufficient. Once this deadline has passed and if Users have still not reported this malfunction, they will be unable to lodge any complaint for these malfunctions. To ensure the proper conservation of these malfunction reports, we recommend that you send them to us in writing (by email or letter). Fundamentally excluded from the hidden defects guarantee are errors resulting from an external influence, errors resulting from your own use, cases of force majeure, or errors resulting from modifications, or other operations that we did not implement.

We do not offer any guarantee in the legal sense.

§ 10 - Software and login data, viruses

On computers, we provide Users with online games and services via a Web browser. We do not supply and do not install the software required on Users’ local computers (in particular the operating system and the Web browser and, if applicable, plug-ins such as Flash or Java). We do not provide any technical support for these. Thus, it is up to Users to maintain their computer in a condition that allows them to use our games. For the corresponding services, we also do not provide any support for installing the local programs required. We are not responsible for any damages or loss of data which may occur on Users’ computers following the installation of software that does not come from us.

Users are required to keep the login data to the game Airlines Manager and/or the services secret and not communicate them to third parties. They must not under any circumstances use the name or password of another Player. Users must inform us immediately if they find out that a third party has obtained their login data. We must warn Users that any access to their game account by a third party, if this occurs after obtaining their login data because of insufficient protection by them, will be interpreted as their own access to the game, even in the case of these third parties violating the contract or the law in general in their name. Therefore, for security reasons, we recommend that you change the different passwords on a regular basis.

We are authorized, of our own will - but without any obligation by us and at our entire discretion - to modify certain login data or prohibit access using this data if we have well-founded reasons to believe that a third party may have obtained this data. We will notify the legal Player immediately and, on request, after a suitable period, we will provide the new login data that has been set up. Users cannot demand the right to the restoration of their original login data.

We protect our systems against viral attacks. However, a viral attack can never be completely excluded. By fraudulently using our names without our agreement, an unauthorized third party may send emails containing, for example, viruses, spyware, or external links to the Internet, links which themselves may contain viruses or spyware. This is outside of our sphere of influence. Consequently, Users must check that each incoming email they receive that uses one of our names as the sender does not contain any viruses. This also applies to the emails from the game’s other Users.

Users must follow the instructions which we, our employees, our assistants, and our agents provide them with. This applies in particular to the instructions of administrators and moderators responsible for the forums pertaining to the games and/or services concerned.

In the event of a problem of use, the declaration of a fault, or a simple suspicion, we reserve the right to log in to a User’s session in order to see the situation for ourselves.

§ 11 - Knowledge and modification of the General Terms and Conditions of Use

By submitting a request to create an Airlines Manager game account and using the game and services, Users acknowledge having read and agreeing to these General Terms and Conditions of Use. These General Terms and Conditions of Use apply to each login or participation in PLAYRION’s games and services.

We reserve the right to modify or add further information to these General Terms and Conditions of Use at any time if we deem it to be necessary, without penalizing Users for their good faith. A modification may be necessary, in particular in order to adapt the General Terms and Conditions of Use to the law in force or to reflect, in a coherent manner, changes concerning the provision of our games and services. New court verdicts are considered as changes to the law in force. Users will be informed of any changes to the General Terms and Conditions of Use in the most appropriate manner. This notification will be published on PLAYRION's website or on the URL of the games concerned via a new window that will open when Users log in, or via an email sent to the address supplied to us by the Users. In all cases, Users will be informed of changes to the General Terms and Conditions of Use by means of a clearly identified notification. Furthermore, they will be asked to accept them.

After reading them, Users have a period of 14 days to challenge the changes or additional information made to the General Terms and Conditions of Use. You are advised to send us your disagreement in writing (for example by email). Changes or additional information made to the General Terms and Conditions of Use take effect for Users if, after 14 days, we have not received any challenge from them or if they continue to use our games and services. In the event of having sent us a challenge within the given period, the two parties may terminate the contract within a period of one month, unless another right of withdrawal applies. The General Terms and Conditions of Use remain valid until the end of the contract. In particular, in this notification, we explain the challenge or termination options, the deadlines and legal consequences, and in particular, the consequences in the case of an omission of a challenge.

§ 12 - General Terms and Conditions of Sale - “AM COINS” & “TravelCards”

Article 1: Scope and Modification of the General Terms and Conditions of Sale

These General Terms and Conditions of Sale are the only ones that apply and replace any other conditions, unless in the case of a prior express and written dispensation. To meet a technical requirement, a service organization need, or a technological upgrade, Airlines Manager may occasionally be required to modify some of the provisions of these General Terms and Conditions of Sale, therefore, it is necessary that these are read again before each order placed on the Airlines Manager website. These modifications apply from the moment they are posted online and cannot apply to contracts that have been concluded beforehand. Each purchase on the website is governed by the General Terms and Conditions that apply on the date of the order. Airlines Manager considers that by validating their order or by clicking on the “checkbox”, Users agree without reserve to these General Terms and Conditions of Sale after having read them.

The modification, interruption, or end of the Airlines Manager service does not entitle Users to any compensation of any kind.

Minors are allowed to buy all the products offered by Airlines Manager provided that they have obtained the authorization to do so from their parents or legal representatives. Simply buying one of the products on sale implies that they have obtained this authorization. PLAYRION reserves the right to request written proof of this at any time and carry out the necessary checks. Any participating minors who are unable to provide this proof within a period of 15 days will lose the benefit of their points and will be excluded from the game.

Article 2a: Definition of the product: "AM Coins"

"AM COINS" is a virtual money that can be used solely in the game Airlines Manager. This virtual money is allocated to Users’ accounts and can be used by them at any time within the limit of the presence of the different methods of use in the game. In the event of a definitive stoppage of the methods of use by the game Airlines Manager, the money which Users have not yet used will be lost.

In no case will Users have the right to give, exchange, or sell their remaining AM COINS to another User. Only the Users that initially acquired their balance of AM Coins are entitled to use them.

The exact composition of a pack of “AM Coins" is indicated on the page "AM SHOP", accessible on the "SHOP" button in the right-hand menu (on the website airlines-manager.com), or in the “DUTY FREE” section accessible via the “DUTY FREE” bag icon at the bottom left of the basic interface (on mobile apps).

"AM Coins" are offered on a “fee-for-service” basis and the detail of the different packages can be consulted directly at the sites indicated above.

Article 2b: Definition of the product: "TravelCards"

"TravelCards" are a virtual money that can be used solely in the game Airlines Manager. This virtual money is allocated to Users’ accounts and can be used by them at any time within the limit of the presence of the different methods of use in the game. In the event of a definitive stoppage of the methods of use by the game Airlines Manager, the money which Users have not yet used will be lost.

In no case will Users have the right to give, exchange, or sell their remaining TravelCards to another User. Only the Users that initially acquired their balance of TravelCards are entitled to use them.

The exact composition of a pack of “TravelCards" is indicated on the page "AM SHOP", accessible on the "SHOP" button in the right-hand menu (on the website airlines-manager.com) or in the “DUTY FREE” section accessible via the “DUTY FREE” bag icon at the bottom left of the basic interface (on mobile apps).

"TravelCards” are offered on a “fee-for-service” basis and the detail of the different packages can be consulted directly at the sites indicated above.

 

Article 3: Ordering process

On the airlines-manager.com website:

After logging in to the game, Users should go to the “Shop” page. They can then choose the number of AM Coins (or TravelCards) they want and their payment method. Once this choice has been made, Players are redirected to the payment page. Clicking on the “Confirm” button on the payment page implies the irrevocable acceptance of the order which can only be challenged within the limits provided for in these General Terms and Conditions of sale. Once the payment has been confirmed, the pack of "AM Coins" (or "TravelCards") ordered by Users is immediately added to their account. In the event of a credit card payment, the confirmation is not immediate. It may take several dozen minutes depending on the state of the network. According to the payment method, Users may receive a confirmation receipt of their order in the “Messages” section or by email.

The order implies the Users’ full and unreserved acceptance of these General Terms and Conditions of Sale and the regulations that apply to the website Airlines-Manager.com.

In the Airlines Manager mobile app:

After logging into the game, Users must go to the “Duty Free” section. They can then choose a packet of AM Coins, TravelCards, or a Mixed packet containing a mixture of money and/or virtual goods. Once this choice has been made, the transaction is performed by the platform (Google Play Store, Apple AppStore, etc.) which will offer the appropriate windows or pages according to the Users’ preferences. Once the transaction is confirmed with the platform, the content of the packet ordered by Users is immediately added to their account. A confirmation of the transaction implies the irrevocable acceptance of the order which can only be challenged with the limits provided for in these General Terms and Conditions of sale.

Article 4: Prices

The prices are those indicated on the website on the date of the order. They include VAT.

The sales price depends on the number of Recharges ordered, the payment method used, and the country of residence of the Users. They are indicated in Euros and include VAT on the site airlines-manager.com site and in the currencies suggested by the platforms on mobile apps.

The offers and prices are valid for as long as they are visible on the site Airlines-Manager.com.

Article 5: Payment Methods

On the airlines-manager.com site, the payment can be made using the following methods according to the country of residence, the product bought, and the choice of the Users: Credit Card, SMS+, Telephone (audiotel), Internet+.

On the mobile app, payment is made via the payment service of the platform that supplied the app (“AppStore”, “Play Store”, etc.). Users are asked to refer to the platform's conditions of use.

Article 6: Justifications

Airlines-Manager.com reserves the right to request the production of proof concerning Users’ identity, their domiciliation, and the payment methods they use to buy the AM Coins (or TravelCards), in particular an identity document, proof of address, and proof of purchase according to the payment methods used, such as a telephone bill, an Internet bill, or a bank statement accompanied by their bank account details. Users must keep the receipts for their purchases for a period of 1 year from the date of payment on the site. In the absence of a reply from Users to a justification request within 15 days, they will lose the benefit of their games and their account in Airlines Manager.

Article 7: Responsibilities

This contract is subject to French law. PLAYRION cannot be held responsible for the non-implementation of the contract concluded in the event of a fortuitous event or a case of a force majeure in the sense of article 1148 of the French Civil Code.

The purchase of AM Coins (and TravelCards) is placed under the sole responsibility of Users. The full or partial inability to use AM Coins (or TravelCards), in particular because of the incompatibility of equipment, cannot result in the payment of any compensation or refunds or the questioning of the liability of PLAYRION. In the event of a problem with the delivery of an order, Users have two months from the date of purchase to contact PLAYRION. After this period, PLAYRION will not accept any complaint.

Article 8: Right of withdrawal

In accordance with article L.121-20 and following of the French Consumer Code, Users have a period of 14 working days from the date on which the AM Coins (or TravelCards) were credited to their account to request a refund of them. For this, they must send a written request by post or by fax specifying their Airlines Manager login (username), their IDC (airline number), their full address, the date of their order and the payment method used. This right of return may only be accepted for orders of AM Coins (or TravelCards) that are complete and that have not yet been consumed, even partially. After receiving and confirming a request, Airlines-Manager undertakes to make the refund within a maximum period of 30 days. In the frame of a transaction made via a third-party platform (Apple AppStore, Google Play Store, etc.), PLAYRION may be unable to influence the exercise of the right of withdrawal and any claim may be treated via the platform that ensured the transaction.

 

 

§ 13- Duration of the contract and termination

Synallagmatic contracts concluded between our two parties (the User and Us) are valid for an undefined period unless specified in other terms in our respective offers. If no agreement for a limited period is indicated for the game’s contract and/or contract for using the services, both parties may terminate the contract at any time with immediate effect.

 

We deem that the contract is not reasonably respected in the following cases:

 

If we terminate a contract for justified and founded reasons, we are allowed to request a sum equal to 75% of the total of all the payments outstanding in the case of a termination within the period defined by the contract (in particular for the purchase of AM Coins (or TravelCards) already ordered). The right to prove that no damages or only negligible damages have been caused remains intact. If the possibility to terminate directly is not provided for in each of the respective games, the termination must be notified in writing. This written notification may be an email. Any termination for exceptional reasons must also be made in writing with details of the reasons.

§ 14- Data protection

 

PLAYRION informs Users that the protection and security of data concerning its transfer over open networks such as the Internet, cannot be guaranteed in view of the current state of technologies. Thus, Users must bear in mind that their Internet provider may, at any time - from a technical point of view - inspect the sites they have visited on the Internet as well as all the data that has been saved. Other Internet Users may also benefit from technical capacities to interfere with the network’s security and control or analyze the traffic of messages. Users are fully responsible for the security and protection of their data stored on Web servers. Personal data will only be saved and used with a view to implementing and processing the contracts concluded with a view to using PLAYRION’s games and/or services or, if necessary, sent to partners or implementation auxiliaries. Otherwise, personal data will be controlled, processed and used only after the express agreement of Users has been obtained or if this is authorized in the frame of the law in force. We do not transfer saved data to third parties without prior agreement; we are naturally bound to this by law.

We are allowed to process Users’ data via external service providers which we have asked to collect the payments owed. We can provide information about the names of these third parties in the case of a written request.

We reserve the right, within the limit of the laws in force, for advertising reasons, market research and development by PLAYRION of products adapted to its Users (games and services), to communicate, without the express agreement of Users, information about other games and their services via electronic notifications, unless they have indicated their wish not to receive them. Users may, at any time, inform us of this wish at no extra cost, except for the cost of transmitting this wish, on the basis of the basic prices in force.

§ 15- Authorization for diffusion

Each Player is able to unsubscribe at any time from the Airlines-Manager-com email service via the unsubscribe link in the electronic message. It will also be possible to notify this by sending a simple letter to PLAYRION at the address mentioned above.

In this hypothesis, Airlines-Manager.com undertakes to stop using the email communicated for sending further messages within a period of 24 to 72 hours.

§ 16- Applicable law and interpretation

Airlines-Manager.com, the game Airlines Manager and these regulations are governed by French law. If applicable, subject to contradictory provisions of public order, any dispute will be submitted to the competent Court of Nanterre (France). Claims or disputes resulting from the interpretation or implementation of these regulations must be submitted by recorded delivery lever with confirmation of receipt to PLAYRION’s headquarters.
